With the help of an insurance disability lawsuit, one woman has had her disability insurance denial reversed on ERISA appeal.

The woman’s appeal claimed that she was wrongfully denied her long-term disability benefits. She suffered from multiple gastro-intestinal conditions, as well a host of other conditions including fibromyalgia, which caused her to apply for disability insurance benefits. The woman claimed that her multiple conditions caused her to lose the ability to do the regular tasks of her job… she was a lawyer.

The woman spent 3 months in the hospital and remains disabled even after her discharge. However, Standard Insurance didn’t believe this and terminated her benefits when they deemed her fit to work. This decision was based on the fact that the woman didn’t go to the doctor for six weeks after she was discharged from the hospital.

Standard claims that she was not disabled anymore by July 20, 2009 (which was just days after she was discharged from the hospital). They also claim that the fact that she didn’t go back to work within a month of July 20 meant that she took longer than the Allowable Period of Temporary Recovery during the Benefit Waiting Period. Because of this, Standard said, the woman wasn’t covered by her policy anymore when she was disabled again on September 10, 2009.

All of the woman’s doctors made it clear that she wasn’t to go back to work after her discharge from the hospital. But the insurance company simply ignored them. This is when the woman hired attorneys to represent her case. In March of this year, the woman was contacted by Standard, which agreed that she was disabled and they returned her benefits.
